Another Eleven Questions Without an Answer
Ever since 15 December I have been awaiting the answers to the second set of 11 questions addressed to the Ministry of Health… my patience has come to an end.
Which is why I come back and say:
Dear Minister Alexandru Rafila,
The undersigned Daniel MV Chitic, Romanian citizen domiciled in Bucharest, …..,
I formulate, on the basis of art. 21 of Law 544/2001, the present
COMPLAINT
against the refusal to
answer the request for information of public interest
requested by the Application made on 15 December 2021, whereby
we respectfully ask you to communicate to me, within the legal term, the following information:
1. What are the medical and legal reasons for which the undersigned, a person immunised and possessing antibodies as a result of infection with Covid-19, am discriminated against by comparison with vaccinated persons who are NOT proved to be immunised or to possess antibodies against COVID?
2. What is the medical reason for which the antibodies acquired by passing through the disease are no longer recognised as effective from the legal point of view from the 181st day after passing through the disease?
3. What is the medical reason for which a person who has passed through the disease and possesses antibodies as a result of infection with Covid-19 must be vaccinated in order to enjoy rights equal to those of a vaccinated person who is not proved to possess antibodies?
4. Is there any danger for persons who have passed through the disease and possess antibodies as a result of infection with Covid-19 in being vaccinated against Covid-19?
5. Why are persons who cannot be vaccinated for medical reasons not exempted from the obligation to present the ELECTRONIC COVID 19 certificate, such reasons as are listed on page 1 of the document “Package leaflet: Information for the user, Comirnaty concentrate for dispersion for injection”, COVID-19 mRNA Vaccine (nucleoside-modified), Warnings and precautions, namely: “Before you are given the vaccine, tell your doctor, pharmacist or nurse if:
- Persons who have had severe allergic reactions or breathing problems after any other injectable vaccine or after you were given Comirnaty in the past.
- Persons who have a severe illness or an infection with a high fever. you have a problem with bleeding, you bruise easily, or you use a medicine that prevents blood clots.
- Persons who have a weakened immune system because of an illness, such as HIV infection, or because of a medicine that affects the immune system, such as a corticosteroid.”
6. If I am immunised as a result of passing through the disease, why, in order to enjoy my fundamental rights and freedoms conferred by the Constitution, must I assume the risks presented on page 2 of the Comirnaty leaflet, namely: “Following vaccination with Comirnaty, very rare cases of myocarditis (inflammation of the heart muscle) and pericarditis (inflammation of the lining outside the heart) have been reported. The cases occurred mainly within two weeks of vaccination, more often after the second administration of the vaccine and more often in younger men. After vaccination, you should be alert to signs of myocarditis and pericarditis, such as breathlessness, palpitations and chest pain, and should seek medical attention immediately if they occur”?
7. Is there any danger that repeated injection, at intervals of 6 months or less, with sera classed as “vaccines” which contain as an adjuvant lipid nanoparticles (CPG 1018 or others) may inhibit or even destroy cellular immunity?
8. Given that the bill provides that “The obligation to request the ELECTRONIC COVID-19 certificate ceases within 72 hours of the date of the finding that the following conditions are cumulatively fulfilled: a) a decline for 3 consecutive weeks in the number of cases at national level; b) the cumulative incidence over the last 14 days at national level is less than 1 per thousand.”, we ask you to state what will be the situation of persons who are unvaccinated but have passed through the disease, or vaccinated with an “incomplete schedule”, should the provisions concerning the compulsory presentation of the ELECTRONIC COVID-19 certificate become applicable again.
9. Given that the only category of diseases which entails the administration of a periodic treatment assimilable to “vaccination” (at intervals of approximately 6 months) is prion diseases, we ask you to state whether SARS-CoV-2 (covid 19) is or is not a prion disease.
10. We ask you to state what is the purpose of the legal provision you are proposing for adoption: the protection of public health by verifying and certifying the population’s immunity to the SARS-CoV-2 virus, or the indirect obliging of the population to administer to itself the medical treatment with the vaccines that protect against “severe forms of Covid19”?
11. What is the constitutional basis for restricting certain fundamental rights and freedoms according to the acceptance of the administration of a medical treatment against my will, all the more so as this treatment is useless so long as I am naturally immunised against the disease?
Accordingly, I ask you to note that since the date of the request for the above-mentioned information 44 days have passed, an interval exceeding by 14 days the maximum term provided by art. 7 para. 1 of Law 544/2001.
In view of this situation contrary to the law, I ask you to order the measures necessary for the return to legality, namely:
I respectfully ask you by this means, on the basis of art. 21 para. 1 of Law 544/2001, to order that disciplinary liability be established for the person guilty of the tacit refusal to answer these questions and, at the same time,
I request you, on the basis of art. 21 para. 3 of Law 544/2001, to supply within a maximum of 15 days the information of public interest requested by the Request for information made on 15 December 2021 and reiterated herein.
