Extending the Offence of Treason
#TheSovereigntyLaw extends the scope of the offence of Treason to any act of exercising a dignity of public office, or an office involving the exercise of state authority, by a Romanian citizen who has entered into relations with a foreign power or organisation or with agents thereof.
In this way an attempt is made to cover an inexplicable “omission” in the present criminal code, which does not punish persons who have connections with, or have been used by, foreign powers and who reach public office or dignity. What, one wonders, produced that “omission”?
The present amendment came about as a result of the suspicions hanging over Prime-sinister Cîțu, according to which he would be the agent of a foreign power — an act which, were it true, would remain unpunished under the present Criminal Code. But not if the Sovereignty Law is swiftly adopted!
Shall we speak of Iohannis as well? Better not… not now, not here.
Here are the reasons behind the decision to make the following amendment to the Criminal Code:
“Article 9
Law no. 286 of 17 July 2009 on the Criminal Code, published in the Official Gazette no. 510 of 24 July 2009, as subsequently amended and supplemented, is amended and supplemented as follows: (…)
(9) In article 394, in paragraph (1), a new letter is introduced, letter e), with the following content:
‘e) the exercise of a dignity of public office or of an office involving the exercise of state authority.’
Explanatory Memorandum:
“Article 9 amends Law no. 286/2009 — the Criminal Code, bringing the legislation in this field into accord with the latest decisions of the Constitutional Court, and also with the legislative amendments introduced by the present legislative proposal. (…)
Paragraph 9 introduces a new letter into article 394 of the Criminal Code, with the marginal title Treason — letter e — in which there is criminalised the act of a Romanian citizen of entering into relations with a foreign power or organisation or with agents thereof, with the aim of suppressing or impairing the unity and indivisibility, the sovereignty or the independence of the state, through the exercise of a dignity of public office or of an office involving the exercise of state authority. Account was taken of the fact that the exercise of a dignity of public office, or of an office involving the exercise of state authority, by the active subject of the offence of treason — namely by a Romanian citizen who has entered into relations with a foreign power or organisation or with agents thereof, with the aim of suppressing or impairing the unity and indivisibility, the sovereignty or the independence of the state — constitutes a danger to national sovereignty and to the security of the state. The exercise of such a dignity of public office, or of an office involving the exercise of state authority, constitutes a real and imminent state of danger for the constitutional and legal order in Romania, without there being any need for the means provided in letters a–d of article 394 of the Criminal Code; for which reason, for the defence of national sovereignty and of economic, financial, health and social security, it is necessary to criminalise this act precisely in order to avoid the consequences of the criminal actions of citizens who have entered into relations with a foreign power or organisation or with agents thereof — the accession of such persons to such an office being the very aim pursued by the foreign powers and organisations or their agents. At the same time, account was taken of the fact that the offence of High treason, provided for and punished by article 398 of the Criminal Code, criminalises only acts committed by ‘the President of Romania or by another member of the Supreme Council of National Defence’, leaving outside criminal illegality the acts committed by the other persons who exercise dignities of public office or offices involving the exercise of state authority.”
