An Addition to Article 297

“3. After paragraph (2) [of article 297 of the Criminal Code — Abuse of office — our note] a new paragraph is added, which shall have the following wording: ‘(3) The act of a public servant of applying any legal norms declared unconstitutional by Decision of the Constitutional Court of Romania is punished by imprisonment of from 7 to 10 years.’”

Paragraph 3 of article 16 of #TheSovereigntyLaw punishes the failure of any person assimilated to public servants to observe the Decisions of the Constitutional Court.

Had the legislative draft “The Sovereignty Law” already been law, the Ombudsman would have been immediately reinstated in office.
